Understanding the 482 Visa Requirements

482 visa

The Subclass 482 Temporary Skill Shortage (TSS) visa is designed to allow Australian employers to address skilled labour shortages by hiring skilled workers from overseas. To qualify for a Subclass 482 visa, there are a number of key requirements that both employers and applicants need to meet.

Nomination by an Approved Sponsor

Firstly, the employer must be an approved sponsor, meaning they have been approved by the Department of Home Affairs to sponsor overseas workers. They must also demonstrate a genuine need for a skilled worker and, where required, that they have tested the Australian labour market before hiring from overseas.

Occupation and Skills Requirements

The position in which the applicant intends to work must be listed on the relevant Skilled Occupation List, which is divided into the Short-Term Skilled Occupation List (STSOL) and the Medium and Long-Term Strategic Skills List (MLTSSL). The applicant must also possess and demonstrate the necessary skills, qualifications and experience required for the occupation and provide evidence of this.

English Language Proficiency

Applicants for a Subclass 482 visa must meet the English language proficiency requirements. This means they must achieve a certain score in an English language test or provide one of the alternative forms of evidence.

Health and Character Checks

To ensure the applicant is in good health and of good character, they may be required to undergo health examinations and are generally required to provide police clearance certificates.

Visa Conditions

A number of conditions are imposed on the Subclass 482 visa, such as work restrictions only allowing the visa holder to work for the sponsoring employer in the nominated position. Adherence to these conditions is essential for both maintaining their current visa and preventing possible future issues with other visa applications.

Please note the above list of requirements, conditions and obligations is far from exhaustive. For employers considering sponsoring overseas skilled workers and those considering applying for a Subclass 482 visa, understanding all requirements is fundamental to lodging a successful application and ensuring ongoing compliance.
