Do I need to be married to apply for an Australian partner visa?
You do not need to be married to apply for an Australian partner visa. The partner visa program recognises both married and de facto relationships.
To be eligible for an Australian partner visa, you must be in a genuine and committed relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen. You must also meet certain other requirements, such as meeting health and character standards and providing evidence of your relationship.
To apply based on a de-facto relationship, you need to evidence:
1. You have lived together for 12 months and your relationship is genuine and continuing
OR
2. Your relationship is registered with Births, Deaths and Marriages, and you live together in a de facto relationship that is genuine and continuing, or you do not live apart on a permanent basis.
You must also meet certain other requirements, such as meeting health and character requirements and providing evidence of your relationship.
